1.1. These Terms and Conditions form a legally binding contract ("Agreement") between you ("User") and JUGA LLC, a limited liability company registered at Sheridan, Wyoming, USA, operating the website at vocesim.com, for the purchase of an international data plan ("Data Plan") via the prepaid eSIM ("eSIM") for use on your personal device ("Device").
1.2. Future agreements between you and JUGA LLC may be subject to additional terms and conditions or documents that may be published on our website or through our application ("App").
1.3. We recommend that you print a copy of this Agreement and these Terms and Conditions for future reference.
2.1. The User can register to purchase an eSIM through our App. By registering and purchasing an eSIM, the User agrees to these Terms of Use. The Privacy Policy and Cookie Policy of JUGA LLC will be displayed on the App when the User registers to purchase an eSIM.
3.1. By purchasing an eSIM from us (through the App), you enter into an agreement with us regarding the purchase of the eSIM, and agree to pay all applicable fees associated with the Data Plan under which the purchased eSIM is subject.
3.2. You are responsible for the eSIM as soon as it is delivered to you. If you damage or lose your Device before fully paying for the eSIM, you are still required to pay the full price of the eSIM.
3.3. You may purchase an eSIM through one of JUGA LLC's third-party partners ("Third Parties"). If you purchase an eSIM through a Third Party, you enter into an agreement with the Third Party, and JUGA LLC is not a party to that agreement.
3.4. JUGA LLC will offer Data Plans linked to specific countries. We reserve the right to restrict the availability of these Data Plans in certain jurisdictions. Users may search, select, and purchase these Data Plans through the App or Third Parties.
3.5. The User agrees to have an unlocked, eSIM-compatible Device necessary to access the eSIM Service.
4.1. This Agreement begins when you purchase an eSIM. Once the eSIM is downloaded to your Device and the Data Plan is activated, the eSIM will remain on your Device after the credit in your Data Plan is used up or the Plan expires. Users are advised not to remove the eSIM from their Device until the Data Plan is fully consumed or expired.
4.2. The term of this Agreement continues until the Data Plan expires or all available credits are used up under the purchased Data Plan.
4.3. This Agreement will terminate immediately upon the occurrence of any of the following events:
4.3.1. the consumption or expiration of the Data Plan as per section 4.2; or
4.3.2. suspension of your use of the eSIM or Data Plan by JUGA LLC due to violation of these Terms and Conditions (including violations of applicable law).
4.4. Upon termination as per section 4.3.1, if you do not remove the eSIM from your Device, it will be provided to you "as is" without any warranty. JUGA LLC will have no further obligations to you in relation to the eSIM unless you purchase another eSIM or Data Plan.
5.1. These Terms and Conditions exist in addition to your statutory rights as a consumer.
5.2. JUGA LLC makes no warranties or representations regarding the eSIM or Service, and all warranties and conditions (whether express or implied, including any implied warranty of merchantability or fitness for a particular purpose) are excluded to the extent permitted by law.
6.1. JUGA LLC will take commercially reasonable steps to ensure that the Service is available for you, subject to the capacity of JUGA LLC and service providers' networks and connectivity.
6.2. JUGA LLC works with service providers, including network operators, which may vary by jurisdiction.
6.3. Please note that if you purchase an "unlimited" Data Plan, your data coverage and speed may be subject to the fair usage policies of the network service provider.
7.1. The User agrees to:
7.1.1. Use the eSIM in compliance with these Terms and Conditions;
7.1.2. Use the eSIM in accordance with the laws and regulations of the country where the User is located or where they usually reside;
7.1.3. Not use the eSIM for fraudulent, criminal, or illegal activities, or in a manner that damages or disrupts the network;
7.1.4. Not use the eSIM for copying, storing, modifying, publishing, or distributing JUGA LLC's commercial information (including trade secrets) except as permitted;
7.1.5. Not use the eSIM to download, send, or upload excessive amounts of content;
7.1.6. Not use the eSIM in a manner that infringes third-party intellectual property rights.
7.2. The User agrees that they will not use promotions, rewards, or referral programs to create fraudulent User registrations or use fictitious identities.
7.3. In case of violation of these Terms and Conditions, JUGA LLC reserves the right to suspend the Service. The User remains responsible for all fees due under these Terms and Conditions.
8.1. Users can register and purchase an eSIM through the App. Payments are processed by an authorized representative of JUGA LLC.
8.2. All eSIMs are pre-paid unless otherwise stated, and Indirect Taxes are included in the prices unless specified otherwise. Indirect Taxes will be charged based on the postal code provided by the User when submitting payment information.
9.1. If you are a consumer, you have the legal right to withdraw from this Agreement within 14 days without providing any reason. The withdrawal period ends 14 days after the purchase of the eSIM or, if earlier, the date the eSIM is activated and the Data Plan is consumed.
10.1. If you believe the Service does not comply with these Terms and Conditions or your statutory consumer rights, please notify us. If appropriate, we will provide a full or partial refund based on the following terms.
10.2. To receive a full refund, the User must meet the following criteria:
10.2.1. The eSIM was purchased from JUGA LLC through the App;
10.2.2. The eSIM has not been activated;
10.2.3. The eSIM was purchased no more than 6 months prior to the refund request.
10.3. In cases where the eSIM has been activated or partially consumed, a partial refund may be provided based on the remaining value of the eSIM or Data Plan.
11.1. The eSIM and all content related to the App, including source code, databases, software, designs, photos, text, graphics, and logos ("Content"), and trademarks, service marks, and logos ("Marks"), are owned by JUGA LLC or licensed to us and are protected by copyright, trademark, and other intellectual property laws.
11.2. No part of the eSIM, Content, or Marks may be copied, reproduced, collected, redistributed, or used for commercial purposes without prior written permission.
12.1. By purchasing the eSIM, you agree that JUGA LLC may process your personal data ("Personal Data") to provide, monitor, and improve the Service and to prevent unauthorized use.
12.2. For more information on how we use your Personal Data, please refer to our Privacy Policy and Cookie Policy.
13.1. The User agrees to indemnify and hold harmless JUGA LLC and its affiliates, officers, agents, and employees against any claims, losses, damages, and expenses arising from:
13.1.1. Violation of these Terms and Conditions by the User;
13.1.2. Misuse of the Service by the User.
14.1. To the fullest extent permitted by law, JUGA LLC accepts no liability for any loss or damage arising from the use of the eSIM or Data Plan. JUGA LLC's liability shall not exceed the amount paid for the relevant Data Plan within the preceding 12 months or €100, whichever is greater.
15.1. This Agreement shall be governed by the laws of Ireland. Any disputes arising from this Agreement will be resolved in the courts of Ireland.
16.1. We may modify the Terms and Conditions at any time. Updated Terms will be available on our App.
17.1. JUGA LLC may transfer or assign its rights and obligations under this Agreement to any of its affiliates or partners.
17.2. If any provision of this Agreement is found to be unlawful or unenforceable, it will be modified to make it enforceable.
